Service Agreement

Welcome! Here’s a clear overview of what you can expect when working with Site Plus Media. We want to keep everything straightforward and transparent, so your project goes smoothly.

Services Provided

• We’ll deliver the package you select—Starter Spotlight, Growth Engine, or Total Takeover—as outlined in our service details. If you want anything extra beyond that, we’ll provide a separate quote.

​

Payment

• To get started, a 50% deposit is needed (this is non-refundable). The remaining 50% is due before we deliver your final files or launch your website. Monthly hosting and email fees begin once your website goes live and are billed in advance.

Timeline

• We’ll agree on a project schedule together. To keep things on track, timely feedback from you is essential.

​

Revisions

• Each package comes with a set number of revision rounds. If you want additional changes, those are billed at $725 per hour.

​

Ownership and Rights

Once you’ve made the final payment, you own all the deliverables—except for some specific rights outlined in the Royalty & Usage Rights section below. We may showcase your project in our portfolio unless you tell us otherwise in writing.

Royalty & Usage Rights

• You receive an exclusive, worldwide license to use your video(s) for all your business and marketing needs, including your website and social media.

• Site Plus Media keeps the underlying copyright and the right to collect any royalties or advertising revenue if your video is monetized on platforms like YouTube, TV, or other ad-supported channels—except for the usual use on your own pages and ads.

• For the first 12 months after delivery, if your video earns revenue through syndication or monetization, Site Plus Media will collect that revenue, or if that’s not possible, you agree to share 50% of it with us within 30 days of receipt.

• After those 12 months, Site Plus Media retains 100% of any royalties or advertising revenue from your video, no matter who uploads or monetizes it. You agree to cooperate with us on this if needed.

• We also reserve the right to showcase your video in our marketing and award submissions.

• Note: Normal use means posting on your own website, social media, or paid ads. It does not include resale or uploading to monetized third-party channels without our written approval.

Additional Terms

Hosting and Support:
We host your website for a monthly fee. Please note that non-payment may lead to suspension of your website and email services.

​

Cancellation:
If you cancel after we’ve started working, we’ll bill you for the work completed at $725/hour and refund any remaining balance.

Liability

​

Our Responsibility:

• Our total liability for anything related to this agreement won’t exceed the total fees you paid us.

​

What We’re Not Responsible For:

• We won’t be liable for any indirect or consequential damages—like lost profits, data, or business opportunities—even if we warned you those could happen.

​

Onsite Property & Equipment:

• While we take great care during shoots, please secure and protect your property and equipment. We’re not responsible for damage caused by unforeseen events, pre-existing issues, or things outside our control.

• If we do cause damage due to gross negligence or willful misconduct, our liability is limited to repair or replacement costs—never more than the fees you’ve paid us.

Delays & Uncontrollable Events:

• Sometimes things happen beyond our control—natural disasters, power outages, or equipment failures. If that occurs, we’ll communicate quickly and work with you to reschedule or adjust timelines.

Data Safety:

• We take reasonable care to protect your digital content, but digital files can get lost or corrupted from things beyond our control. We encourage you to keep your own backups.

​

Your Part:

• To keep things moving smoothly, please provide complete and timely info and access. We can’t be responsible for delays or issues caused by missing or late info from your side.

​

Indemnity:

• You agree to protect and hold harmless Site Plus Media and our team from any claims or damages related to your use of the content we deliver or if you break this agreement.

​

No Guarantees:

• We provide everything “as is,” without warranties, including any specific promises about fitness for purpose or non-infringement.
